3.1 Age: You must be at least 18 years of age to use the Service. By registering, you represent and warrant that you are 18 years of age or older.

3.2 Capacity: You represent that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

3.3 Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.1 Registration: You must create an account using a valid email address and password, or via Google OAuth. You are responsible for the accuracy of all information provided.

4.2 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorised access to your account. We are not liable for losses arising from unauthorised use of your account where you have failed to safeguard your credentials.

4.3 One Account Per User: You may not create multiple accounts to circumvent usage limits, restrictions, or disciplinary actions.

4.4 Email Verification: A verification email is sent upon registration. Certain features may require a verified email address.

4.5 Roles:Accounts are assigned a role of "user", "moderator", or "admin". Role assignments are at the sole discretion of Kalariq Studios. Admins may view user data, adjust wallet balances, and perform moderation actions.

5.1 Prepaid Wallet: The Service operates on a prepaid INR wallet system. You must have sufficient wallet balance before generating images. Your balance is stored securely in our database and is not a regulated financial instrument.

5.2 Generation Costs: Image generation is charged at ₹20 for 2K resolution and ₹30 for 4K resolution per generated image. Costs are deducted via an atomic transaction only after successful generation.

5.3 Failed Generations: If image generation fails for any reason (including AI service unavailability), no INR will be deducted from your wallet. Failures are logged for admin review.

5.4 Daily Recharge Limit: A daily wallet recharge limit of ₹2,000 per user applies (admin accounts are exempt). This limit resets at midnight IST.

5.5 Payment Processing: [Assumption: No payment gateway (e.g., Razorpay) is currently integrated in the observed codebase. Wallet credits are currently added via admin-managed packages. A future payment gateway integration (Zoho Payments) is noted as a TODO in the code. When integrated, additional payment terms will apply.]

5.6 Price Changes: We reserve the right to modify generation pricing or package pricing. We will provide at least 30 days' prior notice of price changes via in-app notification. Continued use of the Service after the effective date of a price change constitutes acceptance.

6.1 Wallet Credits: All wallet credits added to your account are non-refundable, except as required by applicable Indian law or at our sole and absolute discretion.

6.2 Successful Generations: Charges deducted for successfully generated images are non-refundable.

6.3 Disputed Charges: If you believe an INR deduction was made in error, please contact our support team within 7 days of the transaction. We will review the generation logs and respond within 14 business days.

6.4 Account Termination by Us: If we terminate your account without cause, any unused wallet balance will be refunded to you within 30 days.

7.1 Platform IP: All software, design, code, UI/UX elements, AI prompt engineering, and branding of Bhomu and Kalariq Studios are protected by copyright, trademark, and other applicable intellectual property laws. You must not reproduce, distribute, reverse-engineer, or create derivative works of any part of the Service without our express written consent.

7.2 Your Uploaded Content: You retain all ownership rights to the original clothing images you upload. By uploading, you grant Kalariq Studios a limited, non-exclusive, royalty-free licence to store, process, transmit to the AI generation API, and generate images from your uploads, solely to provide the Service to you. This licence terminates when you delete the relevant content or close your account.

7.3 Generated Images: Subject to these Terms, AI-generated model images produced from your uploads are made available to you for your use. You may use them for lawful commercial or personal purposes, including publishing catalogue images for your business.

7.4 SynthID Watermarks: All images generated by the Service contain an invisible Google SynthID watermarkembedded by Google's Gemini AI as part of their responsible AI policy. This watermark is not visible to the naked eye and does not affect commercial use of the image. You must not attempt to detect, remove, or circumvent SynthID watermarks.

7.5 No Claim Over AI Training: We do not claim that we use your uploaded images to train our own AI models. However, third-party AI providers (Google Gemini) may process your images per their own terms and privacy policies.

9.1 "As-Is" Service:The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 AI Output Quality: AI-generated images are produced by a third-party model and may contain imperfections, inaccuracies, or artefacts. We do not guarantee the accuracy, quality, or suitability of any generated image for any specific purpose.

9.3 Availability: We do not guarantee uninterrupted, error-free, or timely availability of the Service. The Service may be suspended for maintenance, upgrades, or due to third-party service outages (Firebase, AWS, Google Gemini, Vercel) without prior notice.

9.4 Third-Party Services: We are not responsible for outages, data loss, or security incidents arising from our third-party sub-processors (Firebase, AWS, Google, Vercel). Each provider is governed by their own terms and SLAs.

10.1 Kalariq Studios shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of your use of or inability to use the Service, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities.

10.2 Our total cumulative liability to you for any claim arising under these Terms shall not exceed the total INR amount you have paid to us in the 90 days immediately preceding the event giving rise to the claim.

10.3 These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

10.4 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable Indian law.

12.1 By Us: We reserve the right to suspend or permanently disable your account, with or without notice, for: (a) violation of these Terms or the Acceptable Use Policy; (b) fraudulent or abusive behaviour; (c) non-payment or chargebacks; (d) legal or regulatory requirements; or (e) any other reason at our sole discretion.

12.2 By You: You may request account deletion at any time by contacting our support team. Upon deletion, your personal data will be removed as described in our Privacy Policy. Unused wallet balance will not be refunded upon voluntary termination (unless we terminate without cause per Section 6.4).

12.3 Effect of Termination: Upon termination, your licence to use the Service ceases immediately. Sections 7, 10, 11, 13, 14, and 15 of these Terms survive termination.

15.1 Informal Resolution: In the event of a dispute, you agree to first contact us at the email listed in Section 19 and provide a written description of the dispute. We will endeavour to resolve the dispute informally within 30 days.

15.2 Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be in India. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon by the parties.

15.3 Consumer Rights: Nothing in this clause prevents you from exercising your rights under the Consumer Protection Act, 2019 or filing a complaint with the relevant consumer forum in India.
